我在申请学校的EB1B,学校律师建议四月初把材料递交出去,但现在我和老公有两个问题不太明白,想请教老师和大家.

我是140的申请人,律师建议在提交140的同时我和老公同时提交485 (他觉得这样方便和快一些). 但老公的H1B在四月底到期,这样我们需要在485提交后再提交H4的申请来保证他的合法的身份.我们不明白这样可行吗?因为这样一来485上他的身份是H1,但同时他的身份在485申请的过程中又会改变;

我们只申请了EB1B,没有提交其他的申请.如果EB1B被拒的话,485也就作费了吗?

-Correct. If you will pay all the fee (filing fee and lawyer fee), you may just file Eb1B I-140 at this time and after your I-140 is approved, you and your whole family then file I-485. If the I-140 is denied, you do not need to waste your money to file I-485 ( a lot of money). So, don't follow the lawyer's suggetions.

我们也想这段时间再准备NIW,但可能还需要一些时间.如果EB1B被拒,NIW刚刚交上,能够把485转到NIW吗?

-No because the NIW priority date is not current.
