我在申请学校的EB1B,学校律师建议四月初把材料递交出去,但现在我和老公有两个问题不太明白,想请教老师和大家.

我是140的申请人,律师建议在提交140的同时我和老公同时提交485 (他觉得这样方便和快一些). 但老公的H1B在四月底到期,这样我们需要在485提交后再提交H4的申请来保证他的合法的身份.我们不明白这样可行吗?因为这样一来485上他的身份是H1,但同时他的身份在485申请的过程中又会改变;
