打算上EB1B，同步递交140/485，这样年底前应该可以拿到EAD和AP。用AP回来。
问题1：如果EB1B的申请被拒了，用过AP回到原雇主处继续H1B工作是不是算黑了身份？
-No, but you need to fiel H1 petition within US immediately to reinstate yoru H1 status after yoru I-485 is denied.

听说申请被拒后，可以通过向某个机构（也许是法庭）申诉，要求重新考虑。这个过程耗时很长。
-You can file I-140 Motion to Reopen/reconsdieration which takes several months to know the results, or you can file I-140 appeal which takes more than one year to know the result.

申诉的律师费要多少？

2.在申诉结果出来前，是不是可以继续合法的留在美国，用H1B继续为原雇主工作？
-Yes, but you had better reinstate your H1 within U.S. by filing H1 petition after I-140 denial.

3.在申诉期间，是否可以续EAD和AP?
-Yes.

4.只要通过EB2的485拿到AP和EAD，那么原来EB1的申诉案子不论输赢应该都不影响我在美国的合法身份了，对吧？

这样有可操作性么？
5.我年底回国大概要待2-3个月，如果不巧这时EB1的申请被拒绝了，我人在境外能够提起申诉么？
