No. You don't have to retain a lawyer. For the situation you describe, the better way is to dissolve the marriage through consultation between your two and reaching an agreement. Your limited amount of asset is not worthy of going through the court for divoirce. You can simply go to Chinese embassy and register for divorce.

Before doing that, any chance you two can mend the fence and save the marriage? Divorce is the solution only if such marriage ends up nowhere.
