Generally, 美国的法律 is better for mom than 中国的婚姻法处理. Also, you should be able to get 小孩的监护权. However, if you 打算带小孩回国内发展, you need to have father's permission.

BTW, for the benefit of the child, you should share custody with father; i.e., have father invovled during kid's grow up.
