OpenAI potential risk & the consequence on AI industry

Musk has a lawsuit claiming he created the open AI as a non profit company and request open AI to be an open source nonprofit organization. If musk wins, that will change the valuation of openAI dramatically?  And lots of big players are tied with open AI like NVDA, AMD, ORCL, MSFT. If musk wins, it will redefine the whole AI industry profitability ?
