First, sure, you can insist that the turning truck did not signal.
Second, you can make the hypothetical argument:
1 The traffic law says you need to signal 100 to 250 yard (can not find the exact number) before making the turn.
2. The turning vehicle can not just signal and declares that road is mine. You need to give straight moving car enough time to respond.
3. Straight moving vehicle has the right of way.
if the staight moving vehicle does not yield, the turning veicle has to wait, you can not just cut it off or run into it.
