Firstly, you need know whether the 肇事司机 has insurance or not. If he has insurance, you can at least get the his maxium insurance cost even he is very poor. You need contact with his insurance company to require it.

Your lawyer is very bad, seems. Fire him if he cannot give your answer. If you want to extra money which more than the insurance limit, a lawyer is better. Or the 肇事司机 insurance company can pay you any resonable cost.
