The guy will fail in the court if the date is over one year. He has to claim the human body damage within one year.

My hu*****and tail-hit a car when he was going to turn right in an intersection. The car was also waiting to turn right. My hu*****and did not stop sooner.

No damage to neither car. The driver and my hu*****and exhanged insurence infomation. We thought it minor. No one call police or took photos.

Two month later, the driver claimed his car has damage inside, and he has physical damage to his back and neck. He asked for $500,000 personal damage compensation.

Our insurence company came to check our car. Our car has no damage at all. So our insurence company denied his claim. that is --- Not event a Penny for him.

Later, some day before the one year expiration. He made another sue, asking for $20,000. This one did not have much money, so no lawyer bothered to represent him. He failed again in the court.

During the whole process, we only signed a statement to out insurence company to say that our car's speed was less than 10Km/hr when the accident happened. No other harrasements.

Our Insurence company said that, there is a chance that we might be the witness in the court to repeat what happened. Because we are "both full-time employed honest people". In case our words goes against his words, the court would choose our words. Our lack of English fluency will actually work for us. Our Insurence company will try to describe the whinning guy as a predator preying on weaker people.

Just reminder, always tell the truth. The Insurence Adjustor knows take efforts to tell liers from truths, and he is very experienced.Although was very friendly, He looked into my eyes when I talked. He then asked my hu*****and to talk the same thing again. He also made some mistakes and ommisions in the statement in favor of us, then readed out loud, asked us to correct any mistakes.
