Assuming Canada has the same bankruptcy system as US, once a petition for Chapter 11 or 7 is filed, the Automatic Stay would be in effect immediately. If you sue the company in local court after knowing the company filed bankruptcy protection, you would be subject to willful violation of automatic stay and also Bankruptcy Rule 9011 Sanction. The only remedy is to file a proof of claim in bankruptcy court as a employment creditor.
