You can do whatever you choose. Be sure to contact the Bankruptcy Court Judge (normally you will talk to his/her law clerk) to find out if you could go ahead with this deal. But what will you do if the owner has involved in some criminal act and then this case will be remanded to other courts? It is a possibility.
