加州高铁贱价征地 美国华裔无奈认命放弃抗争(图)

柬埔寨华侨谢福强（Ken Chea），2004年起在加州佛瑞斯诺（Fresno）接手的一家1950年代即存在的老汉堡店Angelo's Drive-In，由于位于将兴建的加州高铁路径，面临加州高速铁路局（California High Speed Rail Authority）以12万元徵收命运。他虽不打算抗争，但在当地地方报做过记者、目前是洛杉矶时报记者的常客马可姆（Diana Marcum）却打抱不平，替他为文，引起广泛瞩目。
该文指出，当地民众对谢福强如何能以12万元另起炉灶议论纷纷，有人说在佛瑞斯诺要以该价钱另找一间独门独院餐馆根本不可能，起码要准备三倍现金才有可能。政府并只给他90天时间搬迁，要求他在9月15日前搬离该物业。
1981年移民美国的谢福强，在电话受访时，以无奈口吻表示，「我没有选择，不打算对赔偿金额抗争」，因为「请律师要花不少钱，又要等很久时间才有结果」。同时其物业可能先被政府徵收，再等法院有判决出来。以餐馆维生的他说，经营餐馆就是他的全部，不可能将餐馆先搁在一边打官司，那他要做什么、吃什么呢!
该餐馆是由他与同样来自柬埔寨的妻子林素娇（Kay Lim ）经营，他掌厨妻子负责招待。两个24岁及19岁的儿子彼得及提姆（Tim）虽都上大学，也在餐馆帮忙。该餐馆主要服务老客户及其下一代，室内面积1500平方呎，拥有50个座位。据悉，加州高速铁路局提供的12万元，10万元是建筑物及土地赔偿费用，2万元是生意损失及重迁费用（relocation）。
谢福强透露，其实能做的早就做了，包括请不同估价员评估该餐馆物业价值，估出来的价值在14万元至16万元间，已提供给政府单位参考，却未获采纳。但他认为2万元生意损失及重迁费用太低了。 「重迁应该是帮你找好另外一个地方，并做好搬进去的装潢」，他说，餐馆随便装潢都不止2万元! 他目前正找寻的其他餐馆地点，至少都要50万元起价。

Yes, CA Rail Authority cannot evict you themselves. They can only take you to court, and if they win in court, they can 'forcibilly' pay you the money, have local sheriff evict you, and tear down your property. If you resist, you would be violating a court order, they could arrest you for contemp...

很多中国餐馆偷税漏税是个公开的事实，往往手上有两本账，一份自己看，一份用来报税之用。因为不少人上餐馆付现金，所以政府税务部门也不容易捉到漏洞。一般情况下是占了不少便宜。不过遇到征地这种情况，可能就得不偿失了。既然你年年亏蚀，政府怎么可能赔偿你的生意损失，反正你做生意都亏本，现在不正好趁机关门，政府赔偿你已经是天大的恩惠了。这叫做“哑巴吃黄连，有苦说不出”只好说不打算抗争了。

其实他们做了一些事，在公听会上发言，曾经联合征集过签名，但是都没有用。建设项目的立、批过程完整、合法。项目本身应该也是利民的。被拆迁户当然也得到拆迁补偿。但是周围被影响的居民得不到补偿。
你朋友应该在商业区建筑前的居民大会上发言反对，还可以组织其他类似的居民联名发言，甚至起诉。

在北京，这种有50个座位的营业用房，遇到拆迁不要出个天价是绝对不可能搬的。我所知道的一个项目在宣武区，拆迁已经砸了几个亿，还是拆不动，到底项目还是黄了，改迁昌平了。十几万，打发要饭的呢？连个厕所也不止这个价！

You cannot sue to stop the eminent domain order. You can only appeal for "Just compensation", i.e. you have to move, but might get more money. If you don't appeal, then why complain?

遇到同样的状况，国内的人是敢闹，因为闹大了有媒体报道，就算官方媒体不报道，也有国外媒体和网络途径，不知多少有心人等这有人闹呢。美国的人则是有钱拖得起就打官司，没钱拖不起就忍气吞声。谁敢闹啊，因为没有多少媒体不关心，特别是美国主流的媒体。闹大了还有可能被执法部门揍，不幸被打死打残执法部门还是有理的。看前段时间中国学者在美国维权的两则报道，还有这么多美国警察打死人没事的报道，就知道了。美国的媒体就算报道，也就两三天的事，现在还有提前段时间惊动O8的事吗？没有！那像某些有心人对中国的事情这么用心，年年讲，月月讲，就算暂时没得讲，也要挖掘历史来讲。

我上过房地产经纪人的课，为公共事业征用私地没啥可说的。当然价钱是有说道的。仔细阅读文章，餐馆老板说自己找评估员评估的价格也就是14-16万。政府给的钱没少太多，找律师显然不划算。

Mistake again! Judges are paid by private tax-payees, not the government. The rate is determined by the Congress or any state legislature. It is the law itself to guarantee that the judges are got paid, not the government.

The state government should not to use public resource to build railway there if it were not for "public use".
The calculation for the compensation should be provided to the property's owner.
If the calculation were not based on the related law, or has a mistake, it would be another story.

如果没有赔偿上百万的，没有律师会免费打官司提分成。免费打官司提分成是给产品伤害或交通伤害，是赔下半辈子的所有开支的案例，那钱才多。

这种上诉是没有陪审团的。法官一言堂。法官是政府人员，你没有很好的律师，他会向着你吗，慢慢的一层一层的向上告吧。加州铁路局早就和法院通过气了。否则不会开始这动工计划。你要告，排队吧，不止你一个。

律师没有那么可怕，你当然要找征地的专业律师，律师一般会简单地了解一下情况，就能告诉你值不值得打官司。如果律师要你先付钱的，你不找他就是了。楼下这些人真窝囊，被自己的影子给吓着了。本文中的人可能英语不好，所以也讲不明白。

Based on all I know, the priority for the public use of private land has conditions and limitations, such as in the area around a river. It is definitely not the case that the government can want any land that you have.

美国的法律对于公共事业的征地是有优先的， 价格通常不会给的太高，否则官员会被怀疑受贿。政府通常会用自己的房价评估系统，可能比地产税纳税评估稍高但有限或相同。至于生意，则根据年利润来计算，也与纳税多少有关。我们通常会把所有与生意有关的开销去抵税（这样做没有错），但这样会减少利润，会使拆迁赔偿减少。赔偿的计算是有法律根据的，除非有明显错误，否则抗争恐怕也没用。
