It is up to the court to determine whether it is discrimination or not. Once the court decision comes down, it will apply to all similar cases in the future, not just to your case.
Because of the risks involved, most companies would not make perceived "bold" policies and rules for the fear of lengthy legal battles. Regardless the company may win or lose in court, the potential for wasted time, money, and tarnished names will stop companies from making outrageous policies that would negatively affect employees.
