if the other driver does not have an insurance as you described

and you didn't buy uninsured motorist coverage, obviously your insurance will not pay you (please verify with your insurance). but are there any signs making you believe that the other driver does not have an insurance? if that is really the case, the best bet is to file a claim to small claim court to get him. of course you'll only do so after exhaust all other options.
