车祸的问题

今天早上第一次雪天开高速去机场，路上比较滑，所以一路都很小心。快到机场的时，路上的雪也基本没了。此时我正开在左lane上，突然间右边前方不远的一辆suv往左换lane（我记得他没有打灯）。当时我离它只有10米左右的距离，我的第一反应是一脚将刹车踩死。可是根本没用，眼睁睁的看着我的车吻了前车的屁股。

然后我们都靠右把车停在紧急停车带上。对方是一年轻老美。他撕下一张巴掌大小的纸，写下他的名字和电话给我。我向他要保险和驾照，都被他拒绝了。于是我也只给了他我的名字和电话（后来我们电话中交换了insurance信息，听口气，他已经打过电话给他自己的保险公司）。

我问他为什么突然换道，他说他没有，是我开得太快了。我清楚地记得一路上都有雪，而我一直都开在50迈以下。后面路况好了后我也只开到50到60之间,应该低于限速。我还记得当时他前面的车减速了（我看到刹车灯亮了），可能他不想减速，于是突然换道，这样才撞上了的。我跟他解释，他说让保险来判吧。

我想他应该是觉得我的车前部撞到了他车的后部，如果按照追尾算的话，肯定是我输。但是实际情况是他的车突然往左换道，我根本躲避不及。当时拍的照片也能说明这个事实：我车的右前部和他车的左后部有明显的损坏（请看附带的照片）。并且，我的车里还有两个目击者：我老婆和一个朋友（不知道他们能否算人证）。

请问：

从照片分析，我的胜算如何？

教训：

1.看到前方旁边道的车刹车，一定的注意其后的车，因为有些司机不愿减速直接换道。
2.如果紧急刹车，最好不要一脚踩到底。今天我刹车踩的连人都要站起来了也没有用。麻烦哪位老司机说说这种情况应该怎么办。
