which does not requires court judgment for a period of time. However, to extend it the contractor would have to bring the case to the court to get a judgment. If you intend to sell the property in the near future, this could be a problem. Otherwise you may wait until you receive the summon and then decide what to do. But you need to go back to your contract right now to determine whether your case is with merits
