Trespassing crimes are misdemeanors. Sentencing can range from a short stay in the county jail to a fine. Judges will consider whether it is a first offense. However, the offender will have the arrest and conviction on their record unless their sentence includes a provision that would erase the arrest once the offender completes his or her sentence.
