You can always sue them.

But if they really don't have money, you are basically out of luck. But one thing good about obtaining a judgment is that you can put a judgment lien on their property, at least keeping the hope that one day you will get some of that 40,000 grand back. Your friend is correct. There is a statute of limitation of pretty much every civil case.
