You can talk to your HR about the timing issue. They very likely will delay your last day. Maternity leave is short term disability. Does not cost company much. (I have a friend who was laid off while on maternity leave. The last day was set to the end of maternity leave, instead of immediately.)

I am not sure about law. $2500 up front + 35% settlement, seems a lot to me. -- However, I do not know.
