Out of question, in her case the nanny is an employee. By law she would have to pay FICA for her. And if the Nanny is not authorized to work, she may have to pay penalty. In addition, if she lives in New York you would have to buy worker's compensation insurance for her to cover exactly this type of injury. Also, the Nanny weekly pay is below $495, she would have to pay her OT, which can go back as far as her starting date on top of a hefty fine. Well, she's doomed:-)
