If you want to sue the HOA, go to small claim court and

do not, repeat, DO NOT, use a lawyer. You can pay all the money they asked for now and try to get it back later from the court.

Normally, court is more favoring HOA. Lawyers like to have lawsuit. You and HOA are both losers if have a long legal fight. This happened to my neighbor, who ended up declare bankruptcy (own $30~40K legal fee himself, need to pay HOA legal fee and etc.).

As you do not like current HOA board people, try to get into board yourself and elect somebody you like.
