If you are in CA, there is little chance for you to win. Even you go to the court, the judge usually trust people who bear the badge more than you. Only if you have evidence or witness (can be someone sit with you at that moment) can back to claim, you may have a chance.

for $1600, it is not worth it. In this life, sometime you have to accept some bad luck.
