My point is, if you own an apartment building, or quite a few apartments, I can see the violation of fair housing thing. If you only want to rent out your OWN apartment, I don't think your ad should cause this kind of problem. The similar case is, for a small business owner (<15 or 5 or some number of people), it is actually legal to let go employee who is going to take maternity leave.
I don't know much about this issue. Check your state regulation. I would also try to talk to the head of HUD about it. Another you can do is to talk to local press to let people know how their tax dollar is wasted -- depends on the political dynamic of your state, this may not work to your benefit.
