you have the right to fight, which is granted by the U.S. constitution. Basically, if cop does not show up, you definitely win (there is exception such as the cop is on an unexpected duty). Because cop is the one representing people suing you, if cop does not appear in front of the judge, then it means that cop (people) drops the case. Judge is judge, judge can NOT sue you. You win. As a bottomline, you have the option to make deal with the cop by using all kinds of excuses, trying to get a "non-violation" penalty which will not affect your insurance.
