We dont know the nature of the accident.

Does the OP do not care to leave a black mark on his record(s) (whether it is legal or credit).

Better think of possible consequences before taking this route.

This is not like you got in an accident, others struck you, and you sue for compensation.

It sounds to me the OP got an accident, damaged the car but his own car insurance should cover rental - now he cannot prove he is the additional driver, so cannot file claim with his insurance company. The other driver probably does not have car insurance, so has to use him (or her) as the additional driver to file claim.

Above is my guess. Before the OP gives more details, it is difficult to know what actually happened.

I sure hope the OP would not take Old Goat's advice though.
