Morning3evening4 美西游子和懂税的专家,请教IRA Deduction 及 retirement plan 问题!

我在报２０１０税.刚看到　Morning3evening4　http://bbs.wenxuecity.com/inv-tax/219960.html

我爱人的４０１K,自己扣交的少了（没做好tax plan),　我的有雇主提供了retirement plan，但是W-2的１３并没在retirement plan打Mark (check).HR 也没让我们员工自己扣交.结果，ＡＧＩ超过了89K,落在phase-out period is 89K-109K．

我可不可以,　建立我的Traditional IRA, $5000, 可以帮我减少$1000 Fed. tax. 这样会不会被审，危险不,值不值?

我这样做的理由／依据:　the "retirement plan" box in box 13 of your form W-2 should be checked if you ever covered by a plan at work even if you were not vested in the plan. 多谢!
