请教老猫,我应该怎么办

我最近刚刚看中了一个房子,付了1000$的EARNEST MONEY,INSPECTION过后,房子大的毛病是没有,我们也很满意.唯一不满意的地方就是地毯太久了(14年了),另外,壁炉太脏,所以我们就希望卖家走的时候把地毯和壁炉好好清理一下,但是卖家坚决不同意.我的律师说如果我们在这一点上达不成一致,我们有权撤回这个OFFER,并且有权拿回EARNEST MONEY. 因为我们觉得我们的要求很合理,所以看到卖家的这个态度,我们就想撤销这个OFFER, 但是卖家威胁我门说,他们不会退我的EARNEST MONEY,如果我们要是想要钱就去法庭告他们,法院判我们赢他才还我们钱.

我现在觉得就是很郁闷,本来买房子是很高兴的事情,可是被他们这么一弄,心情坏透了,卖家还说我们浪费他们时间.今天和老公商量了一下,决定赌气不买了,反正现在又不是买不到房子,大不了上法庭.因为从来没有到过这种SMALL CLAIM COURT,能不能请老猫或者有经验的人和我说一下,大致程序是怎么样的啊,需要请律师嘛?大概费用是多少,是不是我们如果赢了律师费就应该对方出.另外,我们的案件赢的可能性大嘛? 多谢大家帮忙!!!
