對UA事件的一些非emotion的看法

UA趕客事件已經是鬧的沸沸揚揚。這兩天有空也讀了一下UA的Contract of Carriage（COC)。這裡我用一些非emotional的角度看這事件，也分享一下我的個人看法。基本上這個事件牽涉以下幾個問題。

1. UA是否有權deny boarding？

要理解這個問題首先要理解“what is boarding？”。 一般人理解“boarding”是指乘客在候機廳排隊等候進入機艙時。但其實“boarding”指的是乘客已經進入機艙後。因為如果你在候機廳時有人問你“what are you doing？”，而你回答“I'm boarding the plane”。technically這不是正確答案。正確回答是“I'm waiting to be boarded". 如果你已經在你的機位坐下，人家問你“what are you doing”。正確的回答是“I'm boarding the plane and waiting for departure”。如果你今天去湖邊釣魚，你在走向湖邊的路上時”you are going to fishing， but you are not fishing yet”。you are not fishing until your hook hits the water.  You are not flying until you are on the air.  You are not biking until you are on the bike.  You are not boarding until you are boarded.  

對於UA什麼條件下可以deny boarding，他們的COC寫有兩種情況。Rule25A&B。

Rule25A寫的是 - When there is an Oversold 。。。bla。bla。bla。。。。。

Rule25B寫的是 - Where there is an Oversold  。。。。bla。bla。bla。。。。。。

兩個情況都是under “oversold”的condition。如果UA這次oversold ticket，他們就會說，ooh我們合法地趕走部分乘客。但UA這次並不屬於oversold。這次不是他們的飛機只有100個座位而他們賣了104張ticket。他們沒有extra customer，而是他們要carry extra 4個internal employees。這四個傢伙not even have a valid dam ticket！！！

所以UA想用他們有權deny boarding來辯護是行不通的。

 

2. UA是否有權refuse transport

Airlines和機長有一大堆理由可以eject乘客，但這些理由必須lawful。UA也在COC的Rule21寫明什麼情況下可以拒載。

UA最有可能搬出Rule21.H.2或者Rule21.H.11來指責乘客不服從flight crew的指令所以他們合法地趕人下機。well，如果他們的理由是要執行他們有權deny boarding的權力而這個權力並不成立，他們的指令就變成illegal。你不能因為人家拒絕執行你的illegal指令而強行執行你的refuse transport的權利。你不能跟乘客說請你脫下你的內褲，因為你的內褲顏色和我們死對頭的顏色一樣。你不脫我就拖你出飛機！

所以UA想用他們的REFUSAL OF TRANSPORT條款來推責也是沒戲了。

3. 究竟UA有多少的liability？誰liable乘客的body injury？

UA非法拒載肯定是要付出代價的了。問題是究竟誰負責乘客的body injury賠償？  畫面見到的是航警使用了暴力令乘客受傷。UA是否會說“oh，我們叫警察來處理糾紛，誰知到他們出手這麼重。你找警察局賠償吧”。情形就像如果你發生車禍而和對方發生爭執（你是錯的一方），你報警，警察到場for whatever reason竟然最後將對方槍殺了。誰會被控謀殺/誤殺呢？你會不會因為是車禍的肇事者而一齊被控謀殺/誤殺呢？ UA事件一樣，他們的flight crew和乘客無法達成共識，UA報警處理。警察到場後發生暴力事件。誰負責consequence？UA最可能說“oh，我叫他們來處理事件，但是他們怎麼處理不是我們可以控制的，警察又不是我們的employee”。

UA趕客事件雖然不知道最後他們會賠償多少的錢，但這兩天UA的股價已經蒸發了8億anyway。
