遭遇车祸，对方乘客索赔
 

车祸发生状况如下：

 

驾驶在大雨天，我车内有一位同事，我开车，Toyota Corolla。刹车打滑导致车头转向。对方是Toyota pickup truck，两位老墨撞在我的车门位置驾驶侧，我的头部有1.5英寸长的划口，车子全毁。

对方车子前面受创，没有我们的严重。但事发后，警察到现场，不知如何，双方都用救护车送医院。警察报告说责任在我，我不服有申诉。

我的同事并未受伤，我的伤经两个星期休息基本也恢复，照常上班。

对方驾驶并没有索赔，而且人不见踪影。但是对方的乘客却与律师合作向我方索赔，且狮子大开口，称要16-17万赔偿。

我们的保险是AAA的基本保险，对人员受伤赔偿有每人1.5万的上限限制。由于我们缺乏对车祸受伤的认识，后悔已晚， 所以有此困境。

我们的观点是车祸责任在对方。尽管我们车打滑，但是已经完全停止，而且我们完全无助，对方不应该撞我们，现场只有我们车内两人，对方也是两人老墨 ，无其他目击证人。但对方驾驶失踪，只是乘客老墨在打官司，估计驾驶是非法移民。

目前，第一次调解失败，对方拒绝我方保险公司给的赔偿额，所以我们将要进入法庭的程序。

我们目前只看到对方第一次被救护车拉到医院的费用，并无其他受伤证据。从事故三个都未受伤的情况，对方乘客应是谎称受伤讹诈。

恳请法律专家提供建议，我们应如何才能打赢这个官司。
