遇到无理房东，该怎么对付？

租住在一个两家庭的house 的一楼，房东家住楼上，房子隔音效果非常差， 房东家两个男孩，天天在楼上跑来跑区，而且他们作息很不规律，经常早上4， 5 点就开始活动，住在楼下实在无法忍受，房东人很粗鲁无理，说就是这样，受不了可以搬走（租房时，房东一家不在，其朋友帮他出租的）， 而且要他维修的地方他也不修。 当时填了一份申请，交了一个月房租的定金，并没有正规的lease, 没有注明租住期，当时是口头约定。现在如果搬走， 房东能扣押金吗？ 若他扣押金， 我可以诉他吗？有什么地方可以制约他吗？ 能最后一个月房租不付也不要押金走吗？谢谢个位建议。
