停车场发生的车祸 后续更新

经过漫长时间等待，最近两天忍不住联系了双方保险公司。得知的结果却是大吃一惊，双方保险公司都要“放弃不管”了且事先没有任何通知。对方保险公司称车主所驾驶的车辆是在Enterprise租的车，租车时购买的额外保险承担了对方修车的所需费用，所以没有从原有的保险公司Claim. 而我这边由于是非全保，所以也无法申请arbitration。目前双方保险公司强调他们没有付任何钱，只有我自己上小额法庭了。如果放弃上庭，双方保险公司都各不负责，即我不赔对方，对方也不赔我。

我保险公司的回复：
We cannot issue arbitration since we did not make payment. Since you have liability only and they are not filing arbitration your only recourse to continue is to file small claims court against the other party. If you do file please email me right away with the date you are given and a representative from Mercury can meet you out there.

这种结局是我没有料想到的，除了上庭貌似再没有别的选择了，除非选择忍气吞声。恳请各位兄弟姐妹各抒己见，看下我这种状况还有没有别的方法去解决？如果有，该如何向保险公司提出要求？如果没有，如何去小额法庭申诉？先谢谢大家了。
