if the title is under tenancy in common, the parents can will their 1/3 to whomever they like.

However, if the title is under joint tenancy, the surviving owner has right of survivorship, the title automatically goes to survivors, without going through probate, therefore death will in this case will not be effective. 

You need to look at the land record for this property.
