need retaining wall for that 2 feet difference

Over time, the fence cannot sustain the 2 feet leveling difference, and broken eventually. 

I would ask the neighbor to add retaining wall at his/her side.  If not, file compaint to city.  Once you established good legal ground, add the retaining wall yourself and send bill to the neighbor.  If no response, put lien on the property.
