Thanks for the comment. There is one thing I really don't understand. Is the exchange of emails showing mutual intention to terminate the lease not proper and therefore didn't terminate the lease? Must I used a paper copy of mutual release from contract to terminate the lease?The tenant cannot argue that he sent the email by mistake. After he sent the email he sent at least 5 text message asking whether I received it, and another 10 text message asking where is the check. I saved all of them. But he did sent me an email after a month that he wrote that email because I foreced him. If he didn't I won't give him back the deposit.
here is the email he sent to me:
As our telephone conversation Sunday December 29th am , Miss xxxwe had agree to terminate the lease agreement . I xxxwill not take any civil action against Miss xxx . It is in my opinion that the safety hazards within the home and not being repaired are no fault of hers . I truly believe she was not informed by her leasing agent Mr xxxx xxx . As we agreed upon my $900.00 Hundred dollar deposit will returned over night to this address .. xxxx. At some point today please email me back with your agreement and sending my deposit back on Monday over night. I wish you and your family a wonderful New Year in mind there will be no ill will.
