early termination lease question

Have a tenant (couple with kids).Lease with both names. In eviction process of non-payment and court date end of this month. She asks to pay rent and court fee and she and kids move out before court date, to exchange remove her name from eviction suit.No information about He (they are in process of divorce). If I sign an early termination with her, will that going to cause me anything trouble since we don't have contact of him (He still in the house). Any experience?
