I think you have no good reason to evict them. The court may not support your claim. and you need to spend more to evict them.

My properties are all in California. And I have to be responsible for the water, sewer and garbage payment. this is the common practice in that area. you could talk to other landlord in your area to see the local common practice. Also if you want them to pay, you could check if you write it down in the lease.

as an owner, you have to pay the garbage payment asap and then deal with the tenant. Yould deduct from the deposit when they move out.
