请教一下老朽：南加这边可以签holding deposit说如果申请人搬入前违约，没收holding deposit吗？

我的agent说holding deposit是暂时的，即使申请人A不搬入，找到下一个申请人B搬入之后就要退还A的holding deposit。我查了一下网上说" Non-refundable holding deposits are illegal. In California, there is no such thing as a nonrefundable holding deposit. If a landlord asks for a fee to hold a unit, this is illegal, especially if the landlord states that it is nonrefundable."

我现在有一个申请人8月中旬才打算搬入，所以我想如果法律能允许收holding deposit，如果对方反悔我可以没收这个的话， 就好了。请指教！谢谢！
