If you carry out standard eviction procedure with sheriff
's facilitation, and sheriff recommended moving crew to move out all tenant's belongings, this will be documented in Sheriff's report and there will be no strings attached whatsoever. Tenant will have no base to sue because from the eviction date onward, landlord no longer keeps any tenant's belongings in possession.
So, it's clean.
I rather follow standard sheriff facilitated eviction procedure even if I know that tenant has moved out. I will pay $600 to the moving company even if they have very few or almost nothing to move. You see my point.
