Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.^[1]

译文：国会不得制定有关下列事项的法律：确立一种宗教或禁止信教自由，剥夺言论自由或出版自由，或剥夺人民和平集会及向政府要求伸冤的权利。^[2]

 

就是说，宪法无权给予人们这些自由，因为这些权利是天赋人权，是天生的。不是人所可以给予的。宪法只能保证我们无权剥夺人们的这些自由（信仰自由，言论自由，出版自由，集会自由，请愿自由）。
