Govt 'never attempted to prejudice' case involving SMRT bus drivers: MOMUpdated 07:59 PM Dec 17, 2012SINGAPORE - The "serious accusations" made today by civil society group Function 8 are "entirely baseless", said the Ministry of Manpower (MOM) today.Function 8 had issued a statement calling for the Government, SMRT and the press to stop using the term "illegal strike" when referring to the case where SMRT bus drivers did not report for work as they were unhappy with their pay and living conditions.The group noted that the term "gives the impression that what the bus drivers had done was "illegal" and that there was indeed a "strike""."Since the cases have not been determined by the court, it is grievously wrong and prejudicial to the bus drivers to label their action as an "illegal strike". It is commenting on a pending case and the law is clear that such comments are sub judice and constitute contempt of court," said Function 8.In response, a MOM spokesperson said the Government has "never attempted to prejudice the cases involving the 4 SMRT bus drivers, which is now before the Courts".The spokesperson pointed to the Criminal Law (Temporary Provisions) Act, saying it "clearly outlines" strike action taken in respect of essential services such as public transport would be deemed illegal unless 14 days notice has been given.He also said that Acting Manpower Minister Tan Chuan-Jin, when using the term, "referred to workers participating in the strike in general" and not any particular worker or matter pending before a court of law.Responding to Function 8's query on why the 29 Chinese national bus drivers had their work passes revoked "so swiftly" without being allowed legal representation, the MOM spokesperson said the drivers "were provided with an opportunity to be heard in relation to their conduct during the strike".He added that their work permits were only revoked after "due consideration by the Controller of Work Passes"."There is no requirement for legal representation in such a process, and no request was made in this regard by any of the 29 workers," added the spokesperson.
