Some evidences in his case that are really damaging

1) he took off safety of his gun and put his finger on the trigger --- indication that he intended or prepared to shoot

2) That type of gun is very safe and rarely has accident. You have to pull trigger quite hard to fire a shot

In the light of these facts,  jury believes that he fired his weapon willingly, not accidentally
