-It seems this lawyer is not experienced. Your current employer does not need to file a new PERM because this new/merged company is the successor-in-interest for the old company. So, your current employer (the successor-in-interest petitioner) just need to file the I-140 amendment to take over the approved I-140 and the rights and liabilities of your old employer (old I-140 petitioner). You can file I-485 concurrently with the I-140 amendment if your priority date is current. Discuss my opinion with your lawyer or find another experienced lawyer to help you out.
