谢谢8老师,我可能第一个问题没说清楚,我是想问,公司说准备一个月后layoff了,如果我和公司商量,用non paid leave来拖时间,他们也不用pay我,而我如果能够这样保持住H1b身份,最少可以继续找别的,要不不一定能在一个月之内找到下家
-The problem is that when you do the H1 transfer, you need to provide the recent 3 months paycheck stubs. If you do not get paid, you do not have the payscheck stubs and thus, USCIS may approve your H1 application, but the approval may have no I-94 and then, you just need to go to CHina to get the H1 visa to come back. That is no big deal, anyway.
如果是这种情况,也就是说希望h1b保持但又non paid (也许几个月?不知道有没有时间限制,总之希望拖到和找到的下家接上),不知道可行否?是不是要有合理的解释,比如family reaso?
