请教诸位大侠，EB2 NIW NC cleared in TSC,FP expired,PD 08/2005

Since my PD is not current, but my first and only FP expired more than 7 month (first FP was done in 11/2005), just called TSC for status, it is said case is pending, but since it is not within current process time, they won't issue me second FP, can I make FP myself with local office? I don't want to waste time on waiting FP notice once they process my case

Somebody said for case RD between 2004-2006, even PD is not current, due to NC memo, it maybe still approvable, is that right? this is why I want to make FP appointment from my own, otherwise, according to TSC officer, they won't make a FP appointment until my PD is current, which means some office is beginning to look at my case for final approval

Somebody can help my question on this? really appreciated !

BTW, NC last about 2.5 years, did not do anything like writing to FL or senator.
