You are probably right about this situation with USCIS.
Believe it or not, one of my Indian coworker had the same RD and ND of I-140/I-485 (concurrent filing), and got his case approved in November!

My attorney is to file an Inquiry, since USCIS has a "rule" that if your ND is out of their processing time for more than 30 days, an Inquiry via National service center will be accepted.

I also sent a complaint fax to USCIS-NSC, to the director (which of course, I believe is useless).
