our case is: our tree fell down due to

the heavy wind and caused damage to my neighbor's house, my insurance company told me since it was not our fault, neither me nor my insurance company should pay them any money, they should get money from their own insurance company. Then my neighbor asked us to pay the deductible for them, I checked with my insurance company and some of my american colleague, all the answer are the same: we do not need to pay the deductible for them since it was not our fault unless we want.BTW, the tree was alive, so it was not our fault. If the tree was dead, I think it should be a different story, the owner should take care of it.
