In addition, from the point view of processure, even if someone deserve a death penalty, what was the proper procedure to kill him/her (in general: court sentence, review, execution, etc)?

In an emergancy state (if the emergancy state was declared properly or not: one other question), were there clear predetermined rules that grant the army the right to open fire in some conditions?  What were these rules if there was any?
