report the incident

to the city or something. if it is a licensed day care center, i am sure there is an administrative body that regulates this business.

if you did go to court, the fact that they had insurance or even they offer to pay for your medical bill is not admissible evidence to show liability. the day care center probably does not know this fact, or is worried that their insurance premium will go up.
