伸请破产并不能免除他们的欠款

If any of the following applies, then bankruptcy will not protect a tax payer from the IRS:

1. You can not include any tax debt that is less than 3 years old. So if your tax debt is from last year it can't be included.

2. You can not have any unfiled tax returns.

3. You can not have any tax returns that were audited because you committed tax fraud.

They have an open tax audit, therefore, bankruptcy will not protect them.
