I dont' think you can force the own to surrender her dog just based on what happened to you.

But in gereral, a state should have a "dog on lease" law. Whenever you see this dog is on loose, report to local police immediately and start to build a case against the owner who neglects the public safty. And eventually, she has to give up the dog.
